Hyperion/Cloanto litigation: judgment in the main lawsuit issued
Cloanto had sued Hyperion in
2017, initially to have a judge declare that the Italian company is the
rightful owner of the "Amiga" mark and that Hyperion neither has the right to
fight this trademark registration nor register similar marks like "AmigaOS"
or "AmigaOne" itself. The lawsuit was later merged with another one inititated by Hyperion, which
also added Amino, Itec and Amiga Inc. as additional parties to the litigation
and expanded the scope of the laswuit to cover issues of breach of contract,
trademark violations and alleged IP theft.
Mike Battilana of Cloanto had attempted to also have his 'C-A Acquisition
Corporation', the entity that acquired the Amiga copyrights
from Amiga Inc. in early 2019, added as another plaintiff to the above
lawsuit. The judge denied this
request, since the motion was filed way too late. A few days later, the
C-A Acquisition Corporation filed its own
lawsuit against Hyperion, but this case is currently frozen until the
main lawsuit has been resolved. Already in 2019, the judge declared that Cloanto lacked
standing to sue Hyperion for breach of the 2009 settlement agreement.
Last tuesday, judge Martinez issued a judgment in the
main litigation between Amino, Itec, Amiga Inc. and Cloanto on one side and
Hyperion on the other. Basically, he declared that none of the four
plaintiffs has any standing to sue Hyperion for any of the alleged violations
raised by them:
- In addition to Cloanto (see above), Amino, Itec and Amiga Inc. can't sue
for breach of contract, since they transferred "all rights [...] including
the right to sue [...] for past infringements" to the C-A Acquisition
Corporation.
- Cloanto's accusation that Hyperion changed copyright notices in their
AmigaOS releases to assign ownership to itself, might be a violation of
copyright - but thanks to a "Non-Aggression Clause" in the 2009
settlement agreement, only the C-A Acquisition Corpoation could hold Hyperion
responsible for that.
- The various alleged violations of trademark rights are considered moot,
partially because Hyperion withdrew its objections to the other parties'
marks and abandoned its own attempts to register trademarks in the US and
partially because the only party that could prosecute trademark violations is
C-A Acquisition Corporation.
If none of the parties object to this ruling, the case would end without
resolving any of the issues between Cloanto/C-A Acquisition and Hyperion.
Judge Martinez simply declared that only C-A Acquisition Corporation - renamed to Amiga Corporation in
the meantime - is entitled to sue Hyperion for breach of contract or violating
trademark rights or Amiga related copyright. Such a case already exists, but
has been stayed until the main litigation discussed here is resolved.
Approached by amiga-news.de, Mike Battilana didn't want to issue a statement
"yet". Hyperion posted a press release
on its website, referring to this judgment as a "sweeping victory".

MorphOS: LUA-MUI - Using the scripting language for GUI and OS functions
Stefan 'Kronos' Kleinheinrich's LUA-MUI makes it possible under MorphOS to use the script language LUA (Wikipedia) also to make OS specific calls, i.e. concerning the graphical user interface, libraries and functions. Some examples are documented in the associated forum post of MorphZone.

The Apollo team is organising a demo competition at the "Amiga 38" (7 October, Mönchengladbach). Demo coders can demonstrate their skills in three categories (A500, A1200, Apollo Standalone):

Snake clone: AmiSnakes (beta)
"AmiSnakes" (video) is a Snake clone for one or two players that offers scrolling playfields, a story mode and two-player duels via split screen. The current beta version can be downloaded free of charge. In the final version, better graphics are to be used, and the "Game Over" screen and the credits at the end of the game are still missing. Portable assembler: vasm V1.9c
Frank Wille has updated his portable and retargetable assembler vasm to version 1.9c. AmigaOS 3, 4 and MorphOS as well as TOS, MiNT and Windows are supported. Changes of version 1.9b and 1.9c:
- Fixed a rare expression evalulation bug. Previous versions may erroneously evaluate "label - equate" as constant, when the equate is something like "currentPCsymbol - label".
- Allow a label definition on the same line as a section directive and warn about it.
- Macro arguments were lost at the second repeat-level inside a macro.
- Syntax modules warn about garbage characters in the operand field, when the mnemonic doesn't take any operand.
- No longer cut symbol names in a wide-format listing file after 31 chars.
- Error messages on macros and repetitions now always include the real source file name and line number in parentheses.
- Directives for printing expressions into the console (printv, echo, etc.) now print undefined symbols as "<undefined>+offset".
- New output module "gst" for GST object files (Atari, GST-assembler, Devpac).
- New output file format "dri" for Atari M68k DRI object files.
- m68k: Experimental Apollo TEX instruction, using a simplified syntax after a proposal of John H.
- m68k: Apollo extended/compressed Bcc.B displacements in the range of -256 to 254.
- m68k: MOVEQ.L suppresses any warning about an out of range operand.
- m68k: Allow any size-extension for MOVEQ in Devpac-compatibility mode.
- m68k: Fixed a string-buffer conflict introduced in V1.9a, which occurs when using local symbols in the label field and operand field together with some cpu-specific directives, like EQUR, REG, etc.
- m68k: Optimize small data label in 020 base displacement to a 16-bit offset, or even to (d16,An) when the index is suppressed, provided that options -sd and -extsd have been given.
- 6502: Some mnemonics could be misdetected as implied addressing mode when option -i was given: asl, asr, lsr, rol, ror. 45GS02: aslq, asrq, deq, inq, lsrq, rolq, rorq. WDC02: dec, inc.
- mot-syntax: Do not allow a section with the same name and same type, but with different memory attributes.
- mot-syntax: New option -nolocpfx to disable local symbols by label- prefix (usually '.').
- mot-syntax: ELIF directive implements a real else-if.
- mot-syntax: Export equate symbols with double-colon in vasm-native mode.
- std-syntax: Fixed an issue caused by the introduction of one-digit temporary labels in V1.9a. Labels beginning with _f or _b were misdetected as forward/backward references to such labels.
- std-syntax: Added missing .elseif directive.
- oldstyle-syntax: All byte-directives (byt, byte, dfb, etc.) increment the pc by one without any operand. All word-directives (wor, wrd, word, etc.) increment the pc by two without any operand. Similar to a "declare storage" directive.
- oldstyle-syntax: Whitespace between a label and its colon are allowed again.
- hunk-output: Warn about inability of Kickstart 1.x to initialize BSS sections greater than 256k.
- bin-output: ORIC file names in the tape header are limited to 15 characters and a ".tap" extension is removed automatically.
- bin-output: Added support for the PGX and PGZ format, used by 65816- based C256 Foenix computers.
- tos-output: Support DRI-format object files. New option: -Fdri.

AROS distribution: AROS One 2.0 (x86)
"AROS One", a distribution based on the AROS binary interface ABI v0, is now available in version 2.0 for x86 computers. It can be downloaded as DVD ISO file or as USB flash image at the title link, where you can also find video recordings.

ReAction GUI for XAD: Avalanche 2.1 for AmigaOS 3 and 4
Chris Young's Avalanche is a ReAction-based graphical user interface for the unarchiving system XAD, which also supports the xfdmaster.library and can search for viruses using the xvs.library. With the jump to version 2.1, the developer not only gives the tool a new look, but also introduces simple editing of LhA/Zip archives (Zip requires zip.library - only under AmigaOS 4). The developer has written his tool explicitly for AmigaOS 3.2.1, but has also tested it under AmigaOS 4. Changes:
- New browser mode, removed old hierarchical browser.
- Select/Clear/Invert selection now act on the current directory and all subdirectories when in the new browser mode.
- Basic editing of (LhA, Zip) archives (Zip needs zip.library - OS4 only)
- Create new (LhA, Zip) archives

Disk magazine: Old Power-Brei issues downloadable at Amiga Future (German)
At the title link the issues 1-6 as well as 9-20 of the German-language floppy disk magazine Power-Brei are downloadable, the Amiga Future editors would be grateful for receiving the missing floppy disks as well.
Power-Brei magazine was first published in June 1990, founded by Stefan Kremer and Alexander Carbin, as third senior editor and publisher finally Sven Drieling joined the editorial board. In June 1999 a cooperation with amiga-news.de came about through him. Sven Drieling our news-site owes, beyond the editorial work started at that time, especially many years of extensive programming and maintenance work. (snx)

Video: Background story of the game "Ring around the World"
"Ring around the World" is a point'n'click adventure game about a supposedly drowned man with memory loss, which is also one of three test games for the AMOS Layers System by the same author.

Web browser: AmiFox 0.3
"AmiFox" displays modern web pages on an Amiga by downloading and displaying pages converted to images by a web rendering proxy ("AmiFox server"). Version 0.3 brings various minor changes which, according to the author, are mainly intended to increase the ease of use of the browser:
