Lawsuit: Itec responds to Hyperion In the lawsuit with Cloanto, in March Hyperion did not just sue Cloanto but also all other "Amiga parties", that means all companies which since the year 2000 own or owned rights on Amiga and which all are contract partners of Hyperion: Amino (formerly Amiga Inc., Washington), Itec LLC and Amiga Inc. (formerly KMOS, Delaware). This caused the resurrection of Amiga Inc., followed now by an identical response of Itec LLC - which can be found at the title link, again thanks to the author of the "Amiga Documents". Like Amiga Inc., Itec alleges that Hyperion did break the settlement agreement by e.g. using the trademark AmigaOS for merchandising products or selling AmigaOS 3.1 and 3.1.4 as well as Kickstart 1.2 and 1.3 without having any proper rights. It is also said that the former manager of Hyperion and today's shareholder, Benjamin Hermans, did flaunt to have cheated the Amiga parties by using tricky wording for the settlement agreement which later allowed him to assert rights on a wider scale. In the opinion of the Amiga parties only those rights on AmigaOS 3.1 had been granted to Hyperion which are necessary to develop, sell and promote AmigaOS 4.0. Against this background Itec LLC, like Amiga Inc. before, have requested the court to dismiss the case of Hyperion and/or declare the settlement agreement invalid. (snx) [News message: 08.
