Event: Further pictures of this year's AmiWest

Lawsuit: Application for an interim injunction against Hyperion
In the legal dispute with Hyperion Entertainment (amiga-news.de reported), Amiga Inc., Itec, Amino and Cloanto now have applied for an interim injunction.

With the document (PDF file) Hyperion is supposed to be legally prohibted to sell AmigaOS 3.1.4. This application is based on the claimed break of the settlement agreement from 2009 by using the trademark AmigaOS and the Boing-Ball as well as by selling AmigaOS 3.1.4 including Hyperion's claim to be copyright holder. The involvement of Cloanto is based on its copyright on AmigaOS 3.1 and furthermore on signing of evidences 3 of the former agreement by Cloanto.

The application also confirms that the temporary stop of sales was based on a cease-and-desist letter. Only Hyperion's first service provider, Avangate, did respond but finally informed to continue saling the software as long as a preliminary injunction is not provided. According to conversations of Cloanto with third parties, Hyperion did ensure compensation to the service providers in case of legal actions.

With regard to Hyperion's rights it is said that in the claim in 2007 it was tried to assert section 2.07 of the OEM licence of 2001 which says that Hyperion is allowed to develop further AmigaOS 3.1 and to use its trademarks in case of the insolvency of Amiga Inc. The 2009 settlement agreement was only related to AmigaOS 4. As proof of evidence also Hyperion's own press release is used.

With regard to Cloanto it is said that one of the purposes of the settlement agreement has been to protect diverse rights acquired in 1994. Additional to the usage for the emulator Amiga Forever since 1997, Cloanto could use AmigaOS 1.1 to 3.0 on real Amigas since 1998 and AmigaOS 3.1 since 1999. In the years 2011 to 2016 Cloanto then among others acquired AmigaOS 3.1. The copyright for this version of the operating system the company already registered on 27. April 2007.

By breaking the settlement agreement and selling AmigaOS 3.1.4 financial losses were incurred but also a loss of reputation, the goodwill and of customers. Additionally on 30. November Cloanto was informed by one of its biggest trader that due to Hyperion's statement to the ownership on AmigaOS 3.1.4, Cloanto's AmigaOS-3.1 products are not sold any longer. In several countries the Cloanto's sales have collapsed.

Apart from the losses of Cloanto and the Amiga parties, the application for a temporary injunction is justified by the settlement agreement itself. Provided in paragraph 16, such an apllication is allowed without any proof of an actual loss. Besides, the majority of the sales volume of AmigaOS 3.1.4 was done in the first half of 2018 which generates an additional urgency. (snx) (Translation: dr)

Game launcher: X-bEnCh 1.1 Final Public Release
Jim Neray's X-bEnCH is a graphical user-interface with up to 640 colours (AGA; 128 on OCS/ECS-computers) which can replace the Workbench for launching WHDLoad-games and other applications and requires low hardware resources. An integrated command line as well as the file manager Xpl0rEr (video) are also available.

The final version 1.1 provides many bug fixes (e.g. for block sizes with more than 1024 Bytes), a lot more accurate memory detection method, playlists with up to 256 mods (limited to 100 before), support of scanning up to 4096 sub dirs inside one single dir and pattern filter for the audio playlists requester.

MorphOS: Updates for all #AmigaZeux screenbars
All #AmigaZeux screenbars have been updated improving stability and providing some new functions.

TopTasks.sbar V1.2

  • Added a context menu to entries in the PopWindow Top10 list to break-C/D/E/F/ALL the selected task or to set its priority.
  • Enabled zebra mode (stripes) for task list.
  • Label was overwritten if text was centered or right aligned. Fixed.
  • The Linefeed sneaked back in and got eliminated again (this time for good!). Thanks to jPV :-)
  • Tasknames were truncated to the size in prefs. This of course only works well for fixed fonts. Removed truncation.
  • Catalogs were copied to just locale:[language] and not locale:catalogs/. Fixed. You may want to delete the wrongly copied catalogs.
  • Added french translation by Philippe 'OffseT' Rimauro.
  • Prefs image/object handling was wrong and could lead to crashes. Fixed.

MouseCoords.sbar V1.2

  • Clicking the MouseCoords in the screen title now opens a small window that gives information about the underlying window of the mouse pointer when being moved around. Try it :-)
  • Added a "Distance Moved" window that shows some infos when clicking and holding LMB or MMB and an optional set of qualifiers and moving the mouse around. Threshold can be configured or switched off altogether.
  • Labels were always printed bold. It's now possible to turn bold on/off.
  • Catalogs were copied to just locale:[language] and not locale:catalogs/. Fixed. You may want to delete the wrongly copied catalogs.
  • Added french translation by Philippe 'OffseT' Rimauro.
  • Prefs image/object handling was wrong and could lead to crashes. Fixed.

PixelPicker.sbar V1.2

  • Clipboard Hotkey only copied the contents of Ambient Screenbar's instance. Now works with multiple screens.
  • Catalogs were copied to just locale:[language] and not locale:catalogs/. Fixed. You may want to delete the wrongly copied catalogs.
  • Added french translation by Philippe 'OffseT' Rimauro.
  • Prefs image/object handling was wrong and could lead to crashes. Fixed.
  • Hotkey was freed twice and could lead to crashes. Fixed.

  • Switching between Months/Years/Decades could lead to window size changes and resulted in graphical artifacts on the left side if using transition animations.

PDF magazine: REV'n'GE 93 (Italian/English)
The PDF magazine REV'n'GE ("Retro Emulator Vision and Game") is available in Italian as well as in an English-language translation. REV'n'GE compares and reviews games on vintage computers.

Among others the latest issue includes articles about the Amiga games "Arena", "Atomic RoboKid", "Noddy’s Big Adventure", "Secret of Monkey Island","Starblade" and the multimedia CD-ROM "Advanced Military Systems".

E-Mail programm: SimpleMail 0.45
As usual on Christmas an update of the e-mail programm SimpleMail has been released for AmigaOS 3.x and AmigaOS 4. Version 0.45 provides reduced folder index memory usage, asynchonous index file loading, an updated Italian catalog by Samir Hawamdeh and many bug fixes. (snx) (Translation: dr)

Jump'n Run: The Kiwi's Tale for CD32, AGA and ECS
"The Kiwi's Tale" written by Erik 'Earok' Hogan (video) was developed about 10 years ago for the PC and is meant to be a fan sequel of "The New Zealand Story". There is a version for the CD32 with CD-DA sound and versions for AGA and ECS, currently without background sound.


According to the author the game has the following features:
  • Screen updates with 50hz, smooth eight-ways-scrolling, very big levels
  • Duration like in commercial games
  • 15 levels
  • 2 weapons
  • 3 flight devices
  • 8 kind of enemies
  • 2 final enemies
  • Two players option: the second joystick controls the flight devices
  • CD audio
  • Support of joysticks with one or two fire buttons as well as CD32 joypad
  • Hidden bonus game on disk
Although the author does not describe the game as very "polished", it is completed and in future he is only going to fix bugs. If somebody provided music in MOD format, he would add it to the AGA- und ECS ports. The game requires 2 Megabyte ChipRAM and at least a 68020 processor. Some additional FastRAM is recommended to smoothly play some particularly hectic parts of the game. The ECS port was done at last and therefore has not been extensively tested.

Controls:
  • Fire: Fire button 1
  • Jump: Fire button 2 or 'up'
  • Leaving flight device: Keep pressing the fire button 2 or fire button and 'up'
  • Pause: 'P' or 'Play' (CD32)
  • Quit: 'Escape' or 'Forward'+'Reverse' (CD32)
A 'cheat' the developer also provides: If all levels are supposed to be accessible, in the map view you have to press the Space key for some seconds or the green button (joypad).
